Constitutional litigation claiming the violation of environmental rights by corporations is exploding in Ecuador.  Under the law, standing to file these constitutional actions is given to any citizen in Ecuador, either individually or collectively.  Injunctive and compensatory relief is available in these actions and strict liability rules apply.  There is no statute of limitations for these claims and the defendant has the burden to prove the lack of actual or potential damages.  In addition to damages, courts may grant the plaintiff a financial incentive for bringing the lawsuit of up to ten percent of the final award.

Los juicios constitucionales que reclaman la violación de derechos ambientales por parte de corporaciones están en boga en Ecuador.  De acuerdo con la ley, cualquier ciudadano, tanto individual como colectivamente, tiene legitimación activa para presentar este tipo de juicios.  Los tribuales pueden otorgar órdenes de hacer o no hacer e indemnización por daños y las reglas de la responsabilidad objetiva son aplicables.  Los reclamos de este tipo no son objeto de prescripción extintiva y el demandado tiene la carga de probar la ausencia de daños actuales o potenciales.  Aparte de indemnización por daños, los tribunales pueden otorgar al actor un incentivo financiero por iniciar el juicio de hasta un diez por ciento de la indemnización decretada.
