7th Circ. Wary Of Reviving Barnes & Noble Breach Action: At least one Seventh Circ. judge indicated he was wary of reviving a class action over the company’s 2012 data breach because the customers who lost money in the breach got it back within three days. The decision could give clarity over what amounts to harm in a data breach. (Law360)

3rd Circuit says Marathon can challenge Delaware law later: the Third Circ. Court of Appeals declined to revive a Marathon Petroleum lawsuit that challenged Delaware’s unclaimed property law that cited federal preemption. According to the article, the court said the preemption claim was “premature now but may be viable in the future.” (Reuters)
