  • DOJ False Claims Dismissal Efforts On "Solid Ground"
November 18, 2019

The U.S. Department of Justice’s (DOJ) recent efforts to dismiss what it considers “meritless” False Claims Act lawsuits “appears to be on increasingly solid ground,” Law360 reports.

Nearly two years ago, DOJ officials issued what’s now called the “Granston” memo, which instructs attorneys to dismiss frivolous False Claims Act cases. Earlier this month, three federal judges in three different states granted DOJ’s motions to dismiss, which led one attorney to say the “tide is turning in favor of the government's dismissal authority.” Only two of the DOJ’s 36 motions to dismiss have been denied.
