Kevin LaCroix, the author of the D&O Diary blog, says the Illinois Biometric Information Privacy Act (BIPA) has “become a much more serious concern” over the past year.

LaCroix cites the state Supreme Court’s Rosenbach v. Six Flags Entertainment Corporation case as a watershed moment in BIPA litigation, since the Court ruled that plaintiffs do not have to show “actual injury” to sue under the law. This decision, he has “has significantly encouraged” more BIPA litigation in Illinois.

As more states take up their own biometric privacy laws, LaCroix says “privacy issues will be at the forefront of emerging liability issues in the months and years ahead.”
