Ninth Circuit BIPA Ruling Creates “Staggering” Potential Exposure for Companies: Earlier this month, the U.S. Court of Appeals for the Ninth Circuit recently affirmed certification of a class action ruling against Facebook, finding that alleged procedural violations of the Illinois Biometric Information Privacy Act (BIPA) are enough to pose a material risk of harm for purposes of standing. It is the first federal appellate court to make such a ruling.
