Ninth Circuit Affirms Dismissal of Illinois Biometric Lawsuit: The Ninth Circuit refused to revive a proposed class action under the Illinois Biometric Information Privacy Act that alleged Facebook illegally used facial recognition technology on a photo of the plaintiff that was uploaded by someone else. The three-judge panel said “no reasonable jury could conclude” that Facebook used the technology on the photo. (Law360)

Prop. 65 Lawyers Press On Despite New Coffee Ruling: Despite a California regulator’s conclusion that cancer warning labels are not necessary on coffee products, legal actions continue against makers and sellers under the state’s Proposition 65 law. The California Chamber of Commerce said more than 80 lawsuits are still pending against the coffee industry from a group called the Council for Education and Research on Toxics which lists is address as that of a prolific Prop. 65 plaintiffs’ lawyer.
