The Washington Legal Foundation filed an amicus brief in support of Facebook’s ask that the U.S. Supreme Court review a decision to certify a class action lawsuit that failed to prove concrete harm, Law360 reports.

Facebook petitioned the Supreme Court to review a Ninth Circuit decision that certified a class of about 6 million Illinois-based users who sued the company under the state’s unique Biometric Information Privacy Act. The company said, among other things, that the Ninth Circuit wrongly certified the class because the plaintiffs could not show a real-world harm. The Washington Legal Foundation said these “no-injury class actions allow plaintiffs to extract enormous settlements without proving the merits of their claims."
