The lawsuit filed by the city of Boulder, Colorado, against major energy companies over the potential effects of climate change is now headed to federal court, Legal Newsline reports. 

The city’s lawsuit originally alleged the companies were creating a “public nuisance,” but has now been amended to include an allegation of civil conspiracy. The amendment comes just two weeks after a California federal judge dismissed similar claims against oil and gas companies that were filed by California cities. That same judge also dismissed the notion of a conspiracy by the energy companies in a hearing that proceeded his dismissal.

The city of Boulder’s lawsuit will now be heard by Magistrate Judge Michel E. Hegarty in Denver.
