According to Law360, a recent decision by the Ninth Circuit is “likely to make it easier for plaintiffs to prop up” biometric information privacy class actions around the country.

Last week, the panel upheld a ruling that allowed an Illinois Biometric Information Privacy Act class action lawsuit against Facebook to proceed despite the company’s assertions that the class failed to show a concrete injury caused by their face-scanning technology. The court also refused to say questions regarding the residency of the class members was enough to decertify the class.

A class action defense attorney said the decision “will really give plaintiffs a leg up to bring these cases really anywhere in the country."
