Harold Kim, the new president of the U.S. Chamber Institute for Legal Reform, said the “rise in so-called nuclear verdicts” is “a real emerging problem.”

Kim, who took the reins from Lisa A. Rickard on Jan. 1, 2020, said these verdicts are “really eye-opening in terms of the level of punitive damages.” Though traditionally a “nuclear verdict” was over $10 million, Kim said there have been a rise of multibillion dollar verdicts, in part due to the growth of attorney advertising. Some of these ads, he said, “are deceptive and misleading” and have even triggered warnings from the Federal Trade Commission.
