SCOTUS Won't Hear Biometric Privacy Case

The U.S. Supreme Court declined to hear a challenge to Illinois’ unique Biometric Privacy Information Act, Law360 reports.

Facebook appealed a Ninth Circuit decision that allowed a class action lawsuit under the law to proceed despite the plaintiffs failing to show concrete injury. The company said the lawsuit did not satisfy the standing requirements under the Court’s 2016 decision in Spokeo v. Robins. Litigation under the Illinois law exploded after the Illinois Supreme Court allowed non-injury suits to proceed.
