Lawyers and legal experts told Law360 that an upcoming U.S. Supreme Court case on the Telephone Consumer Protection Act (TCPA) may change the law “as we know it.”

The case itself deals with a TCPA provision that allows government-backed debt collectors to use autodialed calls and texts that otherwise violate the law. The real question, according to Drinker Biddle & Reath partner Michael Daly “is whether to sever the exemption or scuttle the statute." TCPA defense attorney Mark Eisen said the Court striking down the law’s autodialer ban “would certainly result in fewer cases being filed, since the bulk of TCPA litigation stems from this provision.”
