Two defense attorneys run through the changing landscape of biometric privacy laws and how they can affect the legal system in a new Law360 expert analysis piece.

Jeffrey Rosenthal and David Oberly of the Blank Rome law firm say the unique private right of action provision in the Illinois Biometric Privacy Information Act has generated a “tremendous amount of litigation,” including in cases where the plaintiff has not suffered actual harm. Similar laws are being considered in other states with comparable provisions which could create “significant potential liability exposure—for the foreseeable future.”
