A report by attorneys with the Seyfarth Shaw law firm found that website accessibility lawsuits filed under the Americans With Disabilities Act (ADA) have increased 177 percent since last year, the Florida Record reports.
Attorneys Kristina Launey and Minh Wu found the number of these lawsuits went from 814 in 2017 to 2,258 in 2018, with over half of those suits being filed in New York. The New York lawsuits, the authors said, primarily came from only 15 firms. One surprising fact the attorneys found is that California had only ten website-related filings despite having the most total number of ADA lawsuits. However, they say a recent Ninth Circuit decision that came in favor of the plaintiff may “cause the number of website accessibility lawsuits in California federal courts to increase dramatically in 2019."
