“When governments try to criminalize honest businesses, the good guys lose even when they win,” writes the Wall Street Journal editorial board about a case involving a “whistleblower” complaint against Minnesota medical devices company, Vascular Solutions.

Despite an offer by the company to settle over allegations of off-label marketing of a varicose vein treatment, the company was indicted. Vascular Solutions alleged prosecutorial abuse and was ultimately acquitted on all counts. 

“Even sweeter would be if Congress and DOJ used the occasion to institute reforms to ensure accountability for prosecutions that never should have happened,” concludes the editorial.
